SPECIAL MEETING OF THE TOWN BOARD OF
THE TOWN OF NEW HARTFORD, NEW YORK,
HELD AT BUTLER MEMORIAL HALL IN THE VILLAGE OF NEW HARTFORD ON FRIDAY, JANUARY 9, 2004 AT 4:18 P.M.
The Town Supervisor called the meeting to order at 4:18 P.M. and led those in attendance in the Pledge of Allegiance to the American Flag. The roll was then taken with the following Town Officials and Department Heads being present during the progress of the meeting:
TOWN BOARD MEMBERS: Councilman Donald C. Backman
Councilman John C. Waszkiewicz III
Supervisor Ralph B. Humphreys
ABSENT: Councilman David W. Butler
Councilman Richard B. Woodland, Jr.
OTHER TOWN OFFICIALS: Town Clerk Gail Wolanin Young, CMC/RMC
Thereafter, a quorum was declared present for the transaction of business. Due to their full-time employments, Councilmen Butler and Woodland were unable to attend this special meeting.

Raffle Consent
The purpose of the special meeting was to grant approval to the American Heart Association, which is domiciled in the City of Utica, to sell raffle tickets in the Town of New Hartford. This organization had allegedly been misguided by other agencies as to the process and did not submit their application to the Town Clerk’s Office until noon today, January 9, 2004 and the organization had intended to sell raffle tickets beginning Saturday, January 10, 2004 for two (2) cars. Town Clerk Gail Wolanin Young having confirmed that the proper documents had now been submitted, the following Resolution was introduced for adoption by Councilman Waszkiewicz and duly seconded by Councilman Backman:

RESOLVED that the New Hartford Town Board does hereby grant permission to the AMERICAN HEART ASSOCIATION, 1415 Genesee Street, Utica, NY, an organization duly granted a Games of Chance Identification Number by the New York State Racing and Wagering Board, to sell raffle tickets at the Sangertown Square Mall, New Hartford, New York, in accordance with all rules and regulations of said Racing and Wagering Board; and be it

FURTHER RESOLVED that the Town Clerk be, and she hereby is, authorized and directed to execute Form GC-RCF, Raffle Consent Form.
Upon roll call, the Town Board voted as follows:

Councilman Woodland - ABSENT

MATTERS SUBMITTED BY TOWN SUPERVISOR
Financial and Other Routine Reports:
2004 Payroll - Twenty-seven (27) Pay Periods
Since the December 31, 2003 Town Board meeting, Supervisor Humphreys had identified additional positions that he believed should be included in Resolution No. 450, adopted December 17, 2003. Thereafter, the following Resolution was introduced for adoption by Councilman Backman and duly seconded by Councilman Waszkiewicz:
(RESOLUTION NO. 32 OF 2004)
WHEREAS, on December 17, 2003 the Town Board adopted Resolution No. 450 determining that "…all salaried employees.." would have their 2004 annual salary divided by twenty-seven (27) equal paychecks; and
WHEREAS, by Resolution No. 464, adopted December 31, 2003 the Town Board amended Resolution No. 450 to replace "…all salaried employees.." with "…all elected officials, including the Deputy Receiver of Taxes and Assessments.."; and
WHEREAS, the Town Supervisor has identified other job positions that should be included in Resolution No. 450 of 2003;
NOW, THEREFORE, BE IT RESOLVED that the New Hartford Town Board does further amend Resolution No. 450, adopted December 17, 2003 to include the following positions whose salaries shall be divided by twenty-seven (27) equal paychecks in 2004:

The Resolution was declared unanimously carried and duly adopted.
Public Hearing Discussion – Proposed Higby Road Water District
It was the Town Board’s consensus that the Town Clerk arrange for ORRICK, HERRINGTON & SUTCLIFFE, bond counsel, to prepare the Order calling for a Public Hearing on the proposed Higby Road Water District. This matter will be placed on the agenda for the January 21, 2004 Town Board meeting, at which time the public hearing date will be decided.
New York State Archives (NYSA Grant) – Material storage
Councilman Waszkiewicz had identified a grant consultant company that might be willing to write the Files Management grant for the Town; it was the Board’s consensus to proceed as long as the consultant service fees did not exceed One Thousand Dollars ($1,000). The deadline for filing grant applications is February 2, 2004.

There being no further business to come before the Town Board, upon motion of Councilman Waszkiewicz, seconded by Councilman Backman, the meeting adjourned at 4:40 P.M.
