SPECIAL MEETING OF THE TOWN BOARD OF
THE TOWN OF NEW HARTFORD, NEW YORK,
HELD AT BUTLER MEMORIAL HALL IN THE VILLAGE OF NEW HARTFORD ON WEDNESDAY, JUNE 6, 2005 AT 5:30 P.M.
Town Supervisor Ralph Humphreys called the meeting to order at 5:30 P.M. and led those in attendance in the Pledge of Allegiance to the American Flag. The roll was then taken with the following Town Officials and Department Heads being present during the progress of the meeting:

Thereafter, a quorum was declared present for the transaction of business.
Competitive Bid Award – Construction of Higby Road Water District
Robert Guminiak of Burley-Guminiak distributed a proposed Resolution to award various contracts for construction of the Higby Road Water District, stating that no alternates would be awarded on the bids received Friday, May 27, 2005.
Discussion ensued about pricing a meter for the Charles Sitrin Healthcare Center; an estimate for a meter only is about $18,000, which the Sitrin Healthcare Center will pay for. The Sitrin Healthcare Center would like some other items, too and price quotes will be obtained from the bidder, the cost of which will be paid by Sitrin Healthcare. All of the appurtenances will then be located in a building versus a pit.
Upon questioning from the Town Board, Mr.Guminiak responded there is about $45,000 in contingency for this project.
After Supervisor Humphreys executes the Notice of Award, Mr Guminiak will send it to the contractor who will sign it and return it to Burley-Guminiak, together with bonds and insurance. Burley-Guminiak will then refer the documents to Attorney Rossi for his review and acceptance; if the documents are satisfactory, then the Town Supervisor will execute the actual contract with the contractor. Then a Pre-construction Conference needs to be scheduled [projecting a July 1, 2005 timeframe] and a Notice to Proceed

issued to the contractor who has 180 days to complete the project although it is expected that some work won’t be completed til late spring 2006.
Discussion then ensued about what to do with the Giotto and DeBlois residences and whether these property owners should or could be excused from debt reduction – in exchange for easements across their properties – because they had previously installed their own private systems. Mr. Guminiak noted that the Giotti property is presently connected to a twelve (12) inch main and has low water pressure, have some type of …… system which isn’t looked upon well; the Giottio’s could reconnect their existing water line to the main in the high area ---- and they can choose to connect to the high-pressure pipe.
A question arose about water pressure on Wadsworth Road East and that area parallel to Sherman Circle; it wasn’t expected that this area would be positively affected at this time.
Mr. Guminiak believed it was a decision to be made by the Mohawk Valley Water Authority (MVWA) … high pressure is being brought to that area but the rest is up to the MVWA. Councilman Waszkiewicz and Highway Superintendent Cleveland will be meeting with the MVWA on June 9, 2005 and will discuss with them their plans for the Wadsworth/Sherman Drive area.
Thereafter, Councilman Backman introduced the following Resolution for adoption; seconded by Councilman Waszkiewicz:

WHEREAS, the Town of New Hartford has received and reviewed the bid documents and the recommendations of their Engineer for the construction of Higby Road Water Project Contract No. 1 – Water Distribution System, Contract No. 2 – Standpipe Water Storage Tank, Contract No. 3 – Pump Station General Construction, Contract No. 4 – Pump Station Mechanical/Plumbing and Contract No. 5 – Pump Station Electrical;
WHEREAS, the Town of New Hartford is desirous of entering into contracts for the construction of Contract No. 1 – Water Distribution System, Contract No. 2 – Standpipe Water Storage Tank, Contract No. 3 – Pump Station General Construction, Contract No. 4 – Pump Station Mechanical/Plumbing and Contract No. 5 – Pump Station Electrical;

NOW, THEREFORE, BE IT RESOLVED that the Supervisor of the Town of New Hartford is authorized on behalf of the Town Council of the Town of New Hartford to enter into a contract (copies of which are to be filed with the Town Clerk), with the following contractors and in the amount as follows:
This Resolution is subject to the approval and concurrence of the Town’s Attorney.
The Town Clerk polled the Board members who voted as follows:

Councilman Backman - Aye
Supervisor Humphreys - Aye.
The Resolution was thereafter declared unanimously carried and duly ADOPTED.
Discussion then included the Heron Landing Development’s water system that is owned by MVWA but it was noted that the Giotto’s never signed to transfer their private water system to MVWA and DeBlois is clearly privately owned. Determining the value of each system was discussed, with no definitive answer at this time.

At the time of the Public Hearing in February 2004, the Higby Road Water District had 330 parcels; today, there are 360 – 364 parcels which will help lower the debt cost to property owners.
The Highway Superintendent will investigate whether a Water Improvement Area had previously been created for the Heron Landing Development; if so, they shouldn’t have been in the Higby Road water district. He mentioned that the water service area was extended when building construction began in that subdivisin. Mr. Guminiak will send a letter to the Town Board with his idea of value of the aforementioned properties. The Highway Superintendent recommended the Town Board obtain some insight on this from the MVWA. Attorney Rossi’s input will be obtained also..

There being no further business to come before the Town Board, upon motion duly made by Councilman Waszkiewicz and seconded by Councilman Woodland, the meeting was adjourned at 6:28 P.M.
