The Town Supervisor called the meeting to order at 4:35 P.M. and led those in attendance in the Pledge of Allegiance to the American Flag. The roll was then taken with the following Town Officials and Department Heads being present during the progress of the meeting:

Councilman Waszkiewicz was recuperating from injuries sustained in an accident. Thereafter, a quorum was declared present for the transaction of business.
MINUTES
Councilman Woodland introduced the following Resolution for adoption, seconded by Councilman Reynolds:

RESOLVED that the New Hartford Town Board does hereby accept and approve as submitted the minutes of the Regular Town Board meeting held February 1, 2006 and does further waive the reading of the same.
Upon roll call, the Board members voted as follows:

Supervisor Reed - Aye.

Supervisor Reed introduced the following Order for adoption by the Town Board; seconded by Councilman Reynolds:
WHEREAS, a map, plan and report, including an estimate of cost, have been filed in the office of the Town Clerk of the Town of New Hartford, Oneida County, New York, in relation to the establishment of Higby Road Water District Extension No. 1; and
WHEREAS, the improvements in connection with the establishment of said Higby Road Water District Extension No. 1 consists of the construction of a water distribution system, including water mains, hydrants, valves, as well as the acquisition of land or rights-in-land, original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, as more fully described in the aforesaid map, plan and report; and
WHEREAS, the maximum amount proposed to be expended for said improvements is $155,000; and
WHEREAS, an order was duly adopted by said Town Board on January 18, 2006, reciting a description of the boundaries of said proposed Higby Road Water District Extension No. 1, the improvements proposed therefore, the maximum amount proposed to be expended for said improvements, the proposed method of financing to be employed, the fact that said map, plan and report were on file in the Town Clerk’s Office for public inspection, and specifying the 8th day of February, 2006 at 6:00 o’clock P.M., Prevailing Time, at the New Hartford Kellogg Road Community Center, in New Hartford, New York, in said Town, as the time when and the place where said Town Board would meet for the purpose of holding a public hearing to hear all persons interested in the subject thereof concerning the same; and
WHEREAS, such order was duly published and posted in the manner and within the time prescribed by Section 209-d of the Town Law and proof of such publication and posting has been duly presented to said Town Board; and
WHEREAS, said public hearing was duly held at the time and place set forth in said order, as aforesaid, at which time all persons desiring to be heard were duly heard; and

WHEREAS, following said public hearing and based upon the evidence given thereat, said Town Board duly adopted a resolution determining in the affirmative all of the questions set forth in subdivision 1 of Section 209-e of the Town Law and a resolution approving the establishment of said Higby Road Water District Extension No. 1; and
WHEREAS, such resolution establishing the District was adopted subject to permissive referendum; and
WHEREAS, an application for approval to establish Higby Road Water District Extension No. 1 to the Office of the State Comptroller was not required based on the $573 annual cost to the typical property in said District;
NOW, THEREFORE, IT IS
HEREBY
ORDERED by the Town Board of the Town of New Hartford, Oneida County, New York, as follows:
Section 1. Higby Road Water District Extension No. 1, in the Town of New Hartford, Oneida County, New York, is hereby established, to be bounded and described as set forth in Exhibit A attached hereto and made a part hereof.
Section 2. The construction of a water distribution system, including water mains, hydrants, valves, as well as the acquisition of land or rights-in-land, original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, as more fully described in the aforesaid map, plan and report (hereinafter “Higby Road Water District Extension No. 1”) is hereby authorized and approved. The maximum estimated cost to said Higby Road Water District Extension No. 1 pursuant to these proceedings for said construction and improvements shall not exceed $155,000. Said cost of said construction and improvements for said Higby Road Water District Extension No. 1 shall be financed by and through the New York State Environmental Facilities Corporation with the issuance of serial bonds not exceeding $155,000 which mature in annual installments over a period not exceeding thirty years, payable annually as set forth and described in the aforesaid map, plan and report in an amount sufficient to pay the principal and interest on said bonds as the same become due.
Section 3. This order shall take effect immediately.
The question of the adoption of the foregoing Order was duly put to a vote on roll call, which resulted as follows:

The Order was thereupon declared duly ADOPTED. Supervisor Reed complimented the Highway Superintendent and Burley-Guminiak on the professional job done at the February 8, 2006 Public Hearing, noting the happiness of the property owners who had attended that meeting.
On recommendation of the Town Supervisor, Councilman Woodland presented the following Resolution for adoption; seconded by Councilman Payne:

FISCAL
- 2006 Budget Revision
Emergency Dispatch Center Computer Enhancement
Supervisor Reed introduced the following Resolution for adoption; seconded by Councilman Woodland:

OF 2006)
WHEREAS, the Emergency Dispatch Center has requested the purchase of a Hewlett Packard (HP) ProCurve 2626 to improve the speed/efficiency of the Dispatch Center computer system; and
WHEREAS, the cost of said equipment had not been appropriated in the 2006 Annual Budget;
NOW, THEREFORE, BE IT RESOLVED that the New Hartford Town Board does hereby authorize and direct that the Bookkeeper make the following 2006 Budget Revisions to cover the cost of the aforesaid equipment:
Increase Account AA1860.1 Computer Equipment - $500.00
Decrease Account AA1990.4 Contingent - $500.00.
The Resolution was subject to a vote upon roll call, resulting as follows:
